The Gauhati High court have recently asked the state government to give reply on the flexibility of the hiring process in for Assistant Professor recruitment. The ruling comes in the backdrop of the ongoing hiring process in the college recruitment process. The Gauhati High court has asked center to make sure older graduates wouldn’t be penalized because they were marked under a different system. The government have to make the grading fairly because the new recruiters will be benefitting with good marks.

Gauhati High court recent directives: The whole issue explained
The background of the current issue is from a petition by qualified job aspirants (NET, SLET, Ph.D. holders) who challenged the validity of the state’s hiring guidelines issued in January 2022. The petitioners argued that Assam selectively applied UGC regulations, leading to unequal treatment. The Division Bench of Chief Justice Vijay Bishnoi and Justice Suman Shyam issued the order.
As per the new order of January 2022, there was higher weightage (72%) to academic qualifications for some candidates applying under Assistant Professor recruitment who graduated earlier, compared to the UGC’s recommended 50%. This disparity resulted from older grading systems often awarding lower marks. The court found this to be discriminatory.
As per the Gauhati High court’s directive ,The Department of Higher Education in Assam is mandated to create a “rationalization of marks” system to eliminate this unfair advantage. This new system must be developed and implemented within six months.
New Directives of the State Government
The current ruling of the Gauhati High Court is based on the older recruitment system under Assistant Professor recruitment, where the candidate had to give no entrance examination. But in the upcoming days, the new directives of the recruitment process to be followed where there will be ammendment of the 2005 notice and will be an entrance system in the state. This decision had created ruckus all over the state and it is yet to be implemented.
