Board Exam 2022: Supreme Court discards plea to cancel Term 2 board exams

Board Exam 2022: The Supreme Court has rejected the plea which sought the term – 2 board examinations of classes ten and twelve in the online mode. The petitioner had requested to conduct the board examinations in the same manner as the board examinations held last year. The final examinations are to be conducted by the Central Board of Secondary Education (CBSE), Council for the Indian School Certificate Examinations (CISCE), National Institute of Open Schooling (NIOS), and other state boards in offline mode, for which the plea has been put in the court.

The CBSE board, ISCE board along with the other state boards will soon conduct the board examinations of 2022 as per the scheduled timetable in offline mode.

Board Exam 2022: Comments from the Court

The bench that was hearing the plea regarding the cancellation of Board Exam 2022 was headed by Justice AM Khanwilkar and the two other members that were Justice Dinesh Maheshwari and Justice CT Ravikumar. They told the petitioners that by filing the application in the name of public interest litigation, the petitioner had already made a lot of confusion among the students and parents. “For the last four days, through such PILs, you are not only increasing the confusion but also raising false hopes among the students”. “This is an irresponsible misuse of public interest litigation. What kind of petition do people also file?” the court added.

 

Arguments placed by the petitioner

The petitioner, Anubhava Shrivastava Sahai, argued on the fact that since offline classes have not yet started and ongoing online classes are continued, the students have not got the chance to appear and study in schools properly. In addition to that, the courses have not been completed. The petitioner also mentioned that the court had taken into consideration a similar petition last year and the present conditions faced by the students were roughly the same as that of the previous year. As per PIL, it would be best to consider the online assessment of the Board Exam 2022.

Response from the Court

To the arguments placed by the petitioner, the court replied that the board alongside the authorities related to the Board exam 2022 are aware of mentioned issues. “There is no point in interfering in this,” said the court, adding that the petition was not justified at all. “You should desist from filing such a petition. We also want to impose a financial penalty on you. But for now, we are just dismissing it,” the court further responded.

Though many students want an alternative assessment criterion to complete their examinations, many state governments have already scheduled the dates of the final examinations. Be it CBSE or different state boards such as Maharastra, Bihar, or Assam, they have already produced the routine for the Board exam 2022. The ultimate decision has been left over to the authorities by the court. There were also protest regarding the conduction of the online final examination in some parts of Orissa yesterday.
